  Ordinance 574-2019 Group Residential Facility - Secured High Risk

Background

The Board of County Commissioners adopted an interim zoning ordinance (temporary ordinance) on February 6, 2019 to regulate Group Residential Facilities - Secured High Risk. Group Residential Facilities - Secured High Risk house one or more civilly committed Sexually Violent Predators (SVP). A civilly committed individual has completed a criminal sentence, but once they complete their sentence, they must enter a program for treatment and supervision in a secure facility operated by the State. Superior court can order the use of a community-based living facility to carry out these programs. These community-based facilities are known as a less restrictive alternative living arrangement (LRA). A LRA still requires court ordered supervision and treatment.

Federal and state court decisions require cities and counties to allow these secured community-based living facilities. Prior to this ordinance, there were no local regulations for where these types of facilities could be located. The Board is allowed under state law to pass a temporary ordinance to protect the public's safety and welfare. The temporary ordinance is a starting point to ensure neighborhood compatibility when considering the placement of these facilities across the County. The Department will develop a final code over the next six months for the Board to consider. The public is encouraged to participate through this important process.

Wireless communication facilities support the infrastructure system that serves wireless devices (eg. smartphones, tablets, autonomous vehicles, and emergency services).  New or expanded facilities help to maintain or increase system performance, speed, and reliability. Kitsap County must review development permits for these facilities against federal and local standards.  New Federal Communication Commission declarative rulings that support 5G technologies are prompting Kitsap County to update Kitsap County Code Chapter 17.530 Wireless Communication Facilities.

Updating Kitsap County Code is a process which includes opportunities for public dialogue to ensure the interests of all stakeholders are heard. Kitsap County appreciates the time taken by residents to participate in this code update process.

An update regarding the flexibility of maximum lot size requirements was adopted by the Board of County Commissioners on June 11, 2018.  This ordinance will take effect 30 days after adoption (July 11, 2018)
