​   AMENDMENTS TO KCC 18.16 TIMBER HARVEST

Program and Project Information

In late December 2018, the Kitsap County Department of Community Development introduced draft changes to Kitsap County Code (KCC) Chapter 18.16 Timber Harvest. The proposed changes will enable Kitsap County to assume sole regulatory authority from the Department of Natural Resources (DNR) over Class IV-General Forest Practices in accordance with RCW 76.09. Assumption of authority through permitting and enforcement will help to ensure forest practices in the County adhere to the requirements of the Forest Practices Act, the State Environmental Policy Act, and implement the County Comprehensive Plan. Additionally, the program will streamline permitting and monitoring practices.

How can I submit comments about these amendments?

Written comments may address the proposed amendments and staff reports; the SEPA Determination will be noticed and published as required under law. To be included in the official record, written comments must be submitted to the Department of Community Development. Comments for consideration for the Planning Commission draft must be received by January 25, 2019. Comments may be:

  • Emailed to Scott Diener at: sdiener@co.kitsap.wa.us
  • Mailed to Kitsap County DCD, 614 Division Street, MS-36, Port Orchard, WA 98366;
  • Dropped off at the Permit Center on the 2nd Floor at 619 Division Street, Port Orchard;

Public Hearing (Planning Commission, February 19, 5:30 PM)

Oral and written testimony may be made to the Kitsap County Planning Commission during the public hearing scheduled for February 19 at 5:30 PM in the Commissioner’s Chambers on the 3rd Floor of the Kitsap County Administration Building (619 Division St, Port Orchard). The Board of County Commissioner public hearing is yet to be scheduled.

Tips for preparing comments

  • Organize your comments so that general comments and comments regarding particular amendments can be easily distinguished.
  • Be as concise and clear as possible.
  • Explain how the amendment will benefit or affect you.
  • If you plan to provide oral testimony at a public hearing, submitting a written version at the hearing can be very helpful. Please note that oral testimony may be limited to 3 minutes per person/group to ensure everyone wishing to testify can be heard.
  • Including contact information is not required but is very helpful if additional information or clarification regarding your comment is needed.
  • Written comments and oral testimony at public hearings are the only ways for your comments to be part of the official record.

​   WIRELESS COMMUNICATION FACILITY CODE UPDATE

Background:

Wireless communication facilities support the infrastructure system that serves wireless devices (eg. smartphones, tablets, autonomous vehicles, and emergency services).  New or expanded facilities help to maintain or increase system performance, speed, and reliability. Kitsap County must review development permits for these facilities against federal and local standards.  New Federal Communication Commission declarative rulings that support 5G technologies are prompting Kitsap County to update Kitsap County Code Chapter 17.530 Wireless Communication Facilities. 

The proposed code update will balance the need to:

  • expand existing or construct new wireless facilities.
  • ensure compatibility between wireless facilities and surrounding land uses.
  • ensure public health, safety, and welfare. 

The proposal changes Kitsap County Code regarding:

  • Definitions.  The update aligns Kitsap County Code with industry terms and definitions.  
  • Required permits by the type of facility proposed.  Factors that affect the type of permit needed for development include:

        • Built form (tower vs non-tower vs small wireless facilities).
        • Location (ROW vs private land).
        • Existing facilities (collocation vs new facility).
        • Substantial changes to an existing facility.
        • Maintenance, repair, abandonment, removal.

  • Permit review times and duration.
  • Exemptions from State Environmental Protection Act (SEPA) and the permit process.
  • Prohibited location and structure types.
  • General development standards (height, visual appearance, lighting, noise, agreements)
  • Development standards for non-tower facilities vs. tower based facilities
